FITKIND TERMS OF SERVICE

These Terms govern your use of the FitKind mobile apps, Apple Watch app, website, support pages, and related services (the "Service"). FitKind is operated by FitKind Limited ("FitKind", "we", "us", or "our").

FitKind is launching as a personal fitness tracker. The current Service focuses on workout logging, templates, training history, progress tracking, readiness context, wearable/health-platform sync where enabled, account support, and related subscription features. Social networking, public feeds, direct messaging, professional marketplace, organisation portals, and community features are not part of the launch Service unless we separately make them available and update the applicable terms.

Eligibility

You must be at least 18 years old to use FitKind. FitKind is not intended for children or for anyone under 18.

You are responsible for keeping access to your email, device, and account secure. If you believe your account has been accessed without permission, contact support@fitkind.app.

Accounts and Authentication

FitKind uses email-based authentication and may support platform sign-in where available. You agree to provide accurate account information and not to create accounts using automated or misleading methods.

We may suspend or terminate accounts that violate these Terms, create safety risk, attempt to abuse the Service, interfere with other users, or misuse our systems.

Fitness and Health Disclaimer

FitKind is not a medical device, healthcare provider, or substitute for professional advice. The Service may help you record workouts, see training trends, and understand your own fitness data, but it does not diagnose, treat, cure, or prevent any disease or condition.

Exercise involves inherent risk, including property damage, bodily injury, and death. You are responsible for deciding whether an activity is appropriate for you. Stop exercising and seek medical advice if you feel pain, dizziness, shortness of breath, or any other concerning symptoms.

Health Platforms and Wearables

If you connect Apple Health, HealthKit, Apple Watch, Health Connect, or another supported health platform, you authorise FitKind to access only the data types you choose to share. You can change permissions in your device settings.

FitKind uses connected health data to provide the fitness tracking features you request, such as displaying workouts, heart rate, sleep, readiness context, and training history. We do not sell health data and we do not use health data for advertising.

Kit AI and Coaching Content

FitKind may include AI-assisted fitness features such as Kit. AI output can be incomplete, incorrect, or unsuitable for your circumstances. You are responsible for reviewing AI output before relying on it.

Kit is a fitness assistant, not a doctor, dietitian, physiotherapist, mental health professional, or emergency service. Do not use Kit for medical advice, diagnosis, treatment, emergency support, or decisions that require a qualified professional.

User Content

"User Content" means information you create, upload, import, or record in FitKind, including workout logs, templates, notes, progress photos, body measurements, goals, custom exercises, support messages, and other account information you provide.

You retain ownership of your User Content. You grant FitKind a limited licence to host, process, back up, display, and use User Content only as needed to operate, secure, support, and improve the Service.

You must not upload unlawful, harmful, abusive, infringing, misleading, or malicious content. You must not upload content that violates another person's privacy or intellectual property rights.

Acceptable Use

You agree not to:

• Reverse engineer, scrape, overload, probe, or interfere with the Service.
• Attempt to access accounts, systems, data, or functionality without permission.
• Upload malware, exploit code, spam, or deceptive content.
• Misrepresent your identity or affiliation.
• Use FitKind to harm, harass, threaten, or exploit another person.
• Use FitKind for medical, emergency, or high-risk decision-making.

Subscriptions and Payments

Some FitKind features require a paid subscription or in-app purchase at launch. Prices, billing periods, trials, renewal rules, and cancellation options are shown at the point of purchase by the Apple App Store or Google Play.

Apple and Google process launch consumer subscription payments. FitKind does not store full card details. Refunds and cancellations are handled according to the relevant Apple App Store or Google Play rules unless applicable law requires otherwise.

Service Changes

We may update, add, remove, suspend, or change features. We may release future features, including social, marketplace, organisation, or professional tools, under additional or updated terms.

We aim to keep the Service reliable, but we do not guarantee uninterrupted availability. Some features may depend on third-party platforms, device permissions, network availability, or external services.

Intellectual Property

FitKind, including its software, design, brand, logos, content, and technology, is owned by us or our licensors. These Terms do not grant you ownership of FitKind intellectual property.

You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Service except as permitted by law or with our written permission.

Privacy

Our Privacy Policy explains how we collect, use, share, retain, and protect personal data. By using FitKind, you acknowledge that our Privacy Policy applies to your use of the Service.

Termination

You may stop using FitKind at any time. You may request account deletion through the app or by contacting support.

We may suspend or terminate your access if you breach these Terms, create risk for FitKind or others, or if we are required to do so by law.

Liability

To the fullest extent permitted by law, FitKind is provided "as is" and "as available". We do not guarantee that the Service will be error-free, uninterrupted, or suitable for your specific health, fitness, or training needs.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

Governing Law

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply where you live.
